1. Who we are

The app and website are operated by Ethan Ladouceur, trading as Momentum Football, an individual carrying on business in Victoria, Australia (we, us, our). We are the entity responsible for the personal information described in this policy.

Privacy enquiries, requests and complaints can be sent to our Privacy Officer at support@momentumfootball.app. We handle personal information in accordance with the Privacy Act and the APPs, whether or not we are legally required to.

You may use a username that is not your real name. However, because the app is an account-based social service, we cannot offer the app without an email address and a sign-in (APP 2).

2. The personal information we collect

  • Account information: email address, password (stored in hashed form by our sign-in provider, never in plain text), display name, username, profile photo and the date you confirmed you meet the minimum age.
  • Content you create: run posts, photos, captions, stories, coach pages and coach posts, training plans and any messages or reports you submit.
  • Fitness activity: the distance, duration and pace of runs you post, your training plan progress, weekly goal and streaks. See section 7 for location data.
  • Social information: your friends and follows, who has viewed your posts or stories (visible only to you as the poster), and the people you block or report.
  • Purchase information: which subscriptions or plans you hold, their status and renewal dates. Payments are taken by Apple; we do not receive your card or payment details.
  • Technical information: basic device and app information (such as app version, operating system and error logs) needed to run, secure and fix the service.
  • Communications: messages you send to us (for example support requests) and our replies.
  • Website waitlist: your email address and, if you use the plan finder, your answers (goal, level, days per week), the plan suggested, the page and traffic source you came from, and a record of your consent (see section 14).
  • Coaches: if you become a coach, your public coach page, products and prices, and sales and earnings records. If payouts are enabled, our payments provider will collect the identity and bank details needed to pay you; we will tell you who that provider is before you give them anything.

Some of this may be sensitive information under the Privacy Act (for example, fitness and health-related information and photos). We only collect sensitive information with your consent, which you give when you choose to record, post or share it.

3. How we collect it

We collect personal information directly from you (when you create an account, post, contact us or join the waitlist), automatically through your use of the app, and from Apple when it confirms a purchase or subscription. We do not buy personal information from data brokers.

4. Why we collect, use and disclose it

  • to create and secure your account and to provide the app (feed, friends, stories, plans, run tracking, coach pages and purchases);
  • to show your content to the people you choose, and your public coach page to anyone, as described in the app;
  • to process and manage subscriptions, plan purchases and coach earnings;
  • to keep the community safe: reviewing reports, removing content, and suspending or closing accounts that breach our Terms of Use;
  • to respond to your questions and requests, and to fix and improve the app;
  • to tell you when the app launches, if you joined the waitlist; and
  • to comply with the law, including responding to lawful requests from courts, regulators and police, and to establish, exercise or defend legal claims.

We do not sell your personal information, use it for third-party advertising, or track you across other companies' apps and websites. We do not use your information to make automated decisions that significantly affect you.

5. Who we disclose it to

  • Other users. Your profile, posts and stories are visible to the people you choose (for example, accepted friends); stories disappear after 24 hours; your coach page is public if you publish it. You control who you accept as a friend and can block or report anyone.
  • Service providers who help us run the service and are only permitted to use personal information to provide that service to us: Supabase (database, authentication and file storage), RevenueCat or a similar subscription management provider, our website host, and our email delivery provider (used only to send the launch email to people on the waitlist).
  • Apple, which processes payments and operates the App Store under its own privacy policy.
  • Professional advisers, regulators, courts and law enforcement, where required or authorised by law, or where we reasonably believe it is necessary to protect the safety of a person (including a child) or to prevent unlawful activity.
  • A successor, if our business is sold or restructured, on the basis that your information continues to be protected by this policy.

6. Overseas disclosure

Our app database and file storage are hosted by Supabase in the Sydney, Australia region. Our providers are international companies, and their staff and systems in other countries (principally the United States) may access personal information to provide support or services. Apple and RevenueCat process information in the United States and other countries. Our website host may serve pages from servers around the world. Before disclosing personal information overseas we take reasonable steps to ensure the recipient handles it consistently with the APPs (APP 8), typically through contractual terms. By using the app you accept that, where permitted by law, these providers are not subject to the Privacy Act and that we may not be accountable under the Privacy Act for how they handle the information.

7. Location, fitness and health information

  • Location. With your permission, the app uses your device's location only while you record a run, to draw your route and measure distance. We do not use background location and we do not track where you go when you are not recording. A run's GPS track is used on your device. When you post a run, we store the distance, duration and pace, and your photo with the stats and the shape of your route drawn on it. We do not publish a map, your start point or your address.
  • Apple Health. If you choose to connect Apple Health, the app reads only the data types you allow (for example steps and heart rate), displays them to you on your device, and does not upload them to our servers or share them. You can turn this off at any time in the iPhone Settings app.
  • Purpose limit. We never use fitness, health or location information for advertising, sell it, or disclose it to insurers or employers.
  • You can withdraw location permission at any time in iPhone Settings. The run tracker will then not work, but the rest of the app will.

8. Direct marketing

We will only send you marketing messages if you have given consent (for example by joining the waitlist) or where the law otherwise permits, in accordance with the Spam Act 2003 (Cth) and APP 7. Every commercial message identifies us and includes a working unsubscribe link, and we will act on an unsubscribe request within 5 business days (in practice, straight away). We do not give or sell our email lists to anyone else.

9. Age requirement and children

Momentum Football is for people aged 16 and over. We require you to confirm that you are at least 16 when you create an account. We do not knowingly collect personal information from anyone under 16. This reflects Australia's social media minimum age laws (Part 4A of the Online Safety Act 2021 (Cth), as amended by the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth)).

If we learn that an account belongs to someone under 16, we will close it and delete the associated personal information. If you are a parent or guardian and believe your child has an account, please email support@momentumfootball.app and we will act promptly. We follow the Office of the Australian Information Commissioner's Children's Online Privacy Code once it applies to us.

10. Security and data breaches

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure (APP 11). These include encryption of data in transit, row-level access controls in our database so that users can only access data they are entitled to see, restricted administrator access, and use of reputable providers. No method of transmission or storage is perfectly secure.

If we have reasonable grounds to suspect an eligible data breach, we will assess it within 30 days and, if it is likely to result in serious harm, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act.

11. Retention and deletion

We keep personal information only while we need it for the purposes in this policy or as the law requires. You can delete your account at any time in the app at Settings → Delete account. This permanently erases your profile, posts, stories, photos, friends, plans and coach page; routine backups are overwritten within 30 days. We may keep limited records that the law requires us to keep (for example, financial and purchase records, for up to 7 years) and information needed to resolve a dispute or to prevent a banned person from returning. Deleting your account does not cancel an App Store subscription: cancel it in your iPhone Settings.

Waitlist details are deleted on request, and are otherwise deleted after the launch email campaign ends, except that we keep an email address on a suppression list if you unsubscribed, so that we do not email you again.

12. Access, correction and your choices

You can edit or delete most of your information in the app. You may also ask us for access to, or correction of, the personal information we hold about you (APPs 12 and 13) by emailing support@momentumfootball.app. We will respond within 30 days. We do not charge for making a request, we may need to verify your identity first, and in limited cases the law allows us to refuse access, in which case we will tell you why in writing. You can also withdraw consent to marketing at any time, block and report other users, and change app permissions in iPhone Settings.

13. Complaints

If you think we have breached the APPs, contact us at support@momentumfootball.app with the details. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner: oaic.gov.au, phone 1300 363 992, GPO Box 5288, Sydney NSW 2001.

14. Website waitlist: collection notice

This notice is given under APP 5. When you join the waitlist we collect your email address (required) and, if you use the plan finder, your goal, level, days per week and the suggested plan, plus the page and traffic source you came from. We collect it to email you once when the app launches, and to send you your suggested plan if you ask for it. We also record when and how you consented, the wording you agreed to and your IP address, because the Spam Act requires us to be able to prove consent.

If you do not provide your email address we cannot add you to the waitlist; everything else on the website works without it. Your information is stored in our Supabase database in Australia, and is accessible to our email delivery provider only when we send the launch email. It is not sold or used for any other purpose. You can unsubscribe using the link in any email we send or at any time by emailing support@momentumfootball.app, and you can ask for access to or deletion of your details as described in sections 12 and 11. See section 6 for overseas disclosure.

15. Website cookies and similar technologies

This website does not use advertising or analytics cookies. It stores a few small items in your browser's local storage so that it works as you expect: your chosen colour theme, your plan finder answers (so you do not have to enter them again), and whether you have already joined the waitlist. These stay on your device and you can clear them in your browser settings. Our website host may keep standard server logs (such as IP address and pages requested) for security and operation. If we add analytics or advertising measurement tools in future, we will update this policy first and ask for consent where required.

16. Changes to this policy

We may update this policy from time to time. We will post the new version here with a new “last updated” date and, if the changes are significant, tell you in the app or by email.
